  1.                 DECISION CONCERNING PROFESSIONAL SERVICES

  4.       Ministers recommend that the Council for Trade in Services at its 
  5. first meeting shall adopt the decision set out below.

  8.                  WORKING PARTY ON PROFESSIONAL SERVICES
  9.  
  10.       The Council for Trade in Services,
  11.  
  12.       Recognizing the impact of regulatory measures relating to professional 
  13. qualifications, technical standards and licensing on the expansion of trade 
  14. in professional services,
  15.  
  16.       Desiring to establish multilateral disciplines with a view to ensuring 
  17. that, when specific commitments are undertaken, such regulatory measures do 
  18. not constitute unnecessary barriers to the supply of professional services,
  19.  
  20.       Decides as follows:
  21.  
  22. 1.    The work programme foreseen in Article VI, paragraph 4 on domestic 
  23. Regulations should be put into effect immediately.  To this end, a Working 
  24. Party shall be established to examine and report, with recommendations, on 
  25. the disciplines necessary to ensure that measures relating to qualification 
  26. requirements and procedures, technical standards and licensing requirements 
  27. in the field of professional services do not constitute unnecessary barriers 
  28. to trade.

  30. 2.    As a matter of priority, the Working Party shall make recommendations 
  31. for the elaboration of multilateral disciplines in the accountancy sector, 
  32. so as to give operational effect to specific commitments.  In making these 
  33. recommendations, the Working Party shall concentrate on:
  34.  
  35.       -    developing multilateral disciplines relating to market access so 
  36.            as to ensure that domestic regulatory requirements are:  (a) 
  37.            based on objective and transparent criteria, such as competence 
  38.            and the ability to supply the service;  (b) not more burdensome 
  39.            than necessary to ensure the quality of the service, thereby 
  40.            facilitating the effective liberalization of accountancy 
  41.            services;
  42.  
  43.       -    the use of international standards and, in doing so, it shall 
  44.            encourage the cooperation with the relevant international 
  45.            organizations as defined under Article VI, paragraph 5(b), so as 
  46.            to give fully effect to Article VI, paragraph 5;
  47.  
  48.       -    facilitating the effective application of Article VI, paragraph 
  49.            6, of the Agreement by establishing guidelines for the 
  50.            recognition of qualifications.
  51.  
  52.       In elaborating these disciplines, the Working Party shall take account 
  53.       of the importance of the governmental and non-governmental bodies 
  54.       regulating professional services.
